Enforcement Rules for Agricultural Production and Certification Act

Article 1 
These Rules are enacted in accordance with Article 26 of Agricultural Production and Certification Act. (hereinafter referred to as the Act) 
 
Article 2 
The term of circulating process used in Paragraph 1 of Article 4 and Paragraph 1 of Article 5 of the Act shall refer to a transaction process that affects the completeness of agricultural products resulted from physically changing the original packing or original label of good agricultural products or organic agricultural products and agricultural processed products.   
 
Article 3 
The national or international organic accreditation body (organization) that is designated by publication of Central Government level competent authorities under Paragraph 1 of Article 6 of the Act, may make review in advance, and dispatch a person abroad for verification. 
For the above said review, Central Government level competent authorities may invite the authorities concerned, experts and scholars, representatives of the industry or interested bodies to participate in the meeting of review.
 
Article 4 
The term of traceability-based agricultural products used in Paragraph 1 of Article 8 of the Act shall refer to voluntary and mandatory traceability-based agricultural products that are performed under Paragraphs 2 and 3 of Article 7 of the Act.
 
Article 5
If necessary, Central Government level competent authorities may appoint the authorities concerned or juristic person to make accreditation for agricultural certification bodies.
The above said appointee shall meet the following qualifications: 
1. Has the ability to perform the accreditation jobs specified in the Act. 
2. Is qualified as a member of related international accreditation body.
 
Article 6 
The term of relevant certificates and records used in Paragraph 2 of Article 14 of the Act shall refer to source of raw materials, quantity of raw materials, certificate of origin, certification certificate, grounds of productive operation, productive procedure related records, sale target, amounts in connection with check or inspection, and other relevant information required for execution of the Act.
 
Article 7 
The term of other proper measurement used in Paragraph 3 of Article 14 of the Act shall refer to the publication on mass media of name and address of the operator and their agricultural products and processed products thereof or other necessary measurement when actual significant damage or threatened significant damage to consumers occurs and such situation is emergent.
 
Article 8
These Rules shall come into effect upon promulgation.
